These Terms of Service outline the conditions under which Pool Moon LLC provides pool and garden maintenance in Miami, FL.

Welcome to Pool Moon LLC, your trusted partner for professional pool cleaning and yard maintenance in Miami, Florida.
By using our website (www.poolmoon.com) or hiring our services, you agree to the following Terms of Service.
Please read them carefully before engaging our company. If you do not agree, do not use our site or services.

1. Company Information

Pool Moon LLC is a licensed and insured residential pool and garden maintenance company based in Miami, FL.

We serve homeowners, property managers and short-term rental hosts across Miami-Dade County.

2. Services Covered

Pool Moon provides two categories of professional services:

(a) Pool Care & Maintenance
Weekly and one-time pool services including: cleaning and debris removal, skimming, brushing, vacuuming, chemical testing and balancing, filter inspection and routine maintenance, basic equipment checks, algae treatment and startup balancing.

(b) Yard Maintenance & Outdoor Cleaning
Light residential yard and garden care including: leaf and debris removal, lawn blowing, edging and trimming, light hedge/shrub maintenance, sweeping and clearing patios and pool decks, and post-storm debris cleanup.

These services focus on cleanliness and aesthetics. Pool Moon does not perform heavy landscaping, tree removal (large trees), irrigation system repair, construction, or application of pesticides/fertilizers unless explicitly agreed in writing.

3. Scheduling & Property Access

  • Regular maintenance is scheduled in advance according to your selected plan.
  • The Client must provide safe, unobstructed access to the pool and yard areas on service days.
  • If access is blocked (locked gate, dog loose, cluttered deck), the scheduled visit may still be billed.
  • Technicians do not retain client keys. We recommend combination locks or a hide-a-key device.
  • Pets should be secured away from the work area for their safety and the safety of our technicians.
  • Technicians will not climb fences, move heavy furniture, or handle animals.

4. Payment Terms

  • Monthly maintenance plans are billed monthly and payable within 14 days of invoice date.
    The first month or deposit may be required in advance for new clients.
  • One-time services, special treatments, and repairs are payable in full before or at the time service begins.
  • Late payments may incur a $25 late fee and/or interest at 1.5% per month on overdue balances.
  • Pool Moon may suspend or cancel services for accounts more than 15 days past due.
  • Accepted payment methods: major credit/debit cards, ACH, Zelle, or other agreed methods.
  • Prices are “starting at” and may vary by property size, complexity, or special requests;
    Pool Moon may adjust rates with 30 days’ written notice.

5. Client Responsibilities & Safety

a. Pool Owner Obligations

  • Maintain water level at a safe operating height (typically mid-skimmer). Low water can cause pumps to run dry and damage equipment.
  • Run filtration/circulation equipment as recommended: generally 4–6 hours/day in cooler months and 10–12 hours/day during warm/high-usage periods. Adequate circulation is required for effective algae prevention and chemical balance.
  • Ensure pool equipment (pumps, filters, timers, skimmers) is operational between visits. Neglect of equipment may reduce service effectiveness and void guarantees.

b. Yard Owner Obligations

  • Remove or secure fragile plants, pots, decorations, toys, hoses, cords, and personal items from the work area before service.
    Pool Moon is not liable for damage to fragile items or personal property left in the work area.
  • Mark or disclose locations of underground irrigation lines, low-voltage lighting, drains, or other buried infrastructure prior to any work. Pool Moon is not responsible for damage to undisclosed or unmarked underground systems.
  • Do not expect technicians to move heavy planters, large furniture or permanently installed items.

c. General Safety

  • Keep children and non-swimmers supervised. Pool covers, while useful, are not a substitute for supervision.
  • Pool Moon technicians do not perform electrical or heater adjustments. If you have heater or electrical concerns, notify us and we will recommend a licensed technician.
  • Clients are responsible for maintaining gates, locks, alarms, and other safety devices in working order.

6. Filter Cleaning & Equipment Maintenance (accurate procedure)

Proper filtration is essential to water clarity and equipment longevity. Pool Moon performs filter maintenance according to filter type:

  • Cartridge Filter: full cleaning once a month (or sooner if the water becomes cloudy or system pressure is too high).
  • Sand Filter: backwash once a month.
  • DE Filters: we perform a backwash with a small DE powder recharge approximately every 2 months (included).
    A deep internal cleaning is billed separately every 6 months, starting at $60 depending on filter size and condition.

Filter replacement — when a cartridge, sand media, or DE grid becomes too worn or damaged to clean properly — is not part of routine maintenance. Any required filter replacement (parts and labor) will be quoted and billed separately upon client approval.

Clients are responsible for authorizing deep cleanings or replacements when required. Failure to maintain or replace filters as needed may result in reduced water quality or equipment damage for which Pool Moon cannot be held liable.

7. Chemicals, Products & Environmental Practices

  • Standard pool chemicals required for routine maintenance — including chlorine, pH and alkalinity adjusters, stabilizer (CYA), and calcium hardness treatments — are included in regular service.
  • Specialty treatments (such as phosphate removal, shock treatments, stain or scale removal, or partial water replacement when CYA or calcium hardness or Total Dissolved Solids is excessively high) are not included and will be quoted separately.
  • For yard work, Pool Moon uses eco-friendly practices and will not apply pesticides, herbicides, or fertilizers unless expressly agreed in writing.

8. Weather, Storms & Rescheduling

  • Service may be limited or postponed during heavy rain, lightning, or unsafe weather.
  • Post-storm cleanup beyond normal service levels (large amounts of debris, broken branches, displaced landscaping) is billed separately after client approval.
  • Freezing conditions (rare in Florida) may limit vacuuming or pump shutdown to avoid equipment damage.

9. Liability, Documentation & Limits of Responsibility

a. Fragile Items & Personal Property

Client is solely responsible for removing or protecting fragile plants, pots, garden ornaments, furniture, decorations, hoses, toys, and other personal property from the work area prior to service. Pool Moon will exercise reasonable care, but is not liable for damage to fragile items or personal property left in the work area. Client should identify and notify Provider of any items of special concern in writing.

b. Underground Utilities & Irrigation

Client must disclose locations of all underground utilities, irrigation lines, lighting conduits, septic or drainage lines. Pool Moon is not responsible for damage to undisclosed or unmarked buried systems. If Provider must locate or expose buried utilities, the Client will be responsible for related charges.

c. Pre-Existing Conditions & Equipment Failure

Pool Moon is not liable for pre-existing defects, hidden damage, or failures of pool shells, decking, irrigation, or equipment. If hidden conditions are discovered that increase the scope or cost of work, Provider will notify Client and provide a revised estimate.

d. Additional Debris & Post-Storm Charges

Extra debris volume beyond normal maintenance (for example after storms or seasonal leaf drop) may incur additional charges. Provider will obtain Client approval before performing billed extra work.

e. Photo Documentation & Proof of Service

Provider may take photographs or notes of the work area before and after service for documentation and claim prevention. By using our services, Client consents to such documentation.

f. Indemnification

Client agrees to indemnify, defend, and hold harmless Pool Moon LLC, its employees and contractors from and against any claims, liabilities, damages, losses and expenses (including reasonable attorney’s fees) arising from Client’s negligence, failure to disclose relevant information, or failure to secure animals or property.

g. Limitation of Liability

Except for liability resulting from gross negligence or willful misconduct, Provider’s total liability for direct damages is limited to the total amount paid by the Client to Pool Moon for the affected services during the preceding 12 months. In no event will Provider be liable for incidental, consequential, punitive, or special damages.

10. Cancellations, No-Show & Refunds

  • For recurring services, cancelations require 30 days’ written notice.
  • For one-time services, cancelations typically require 24–48 hours’ notice depending on the job; late cancelations or no-shows may incur a fee.
  • Missed visits due to blocked access are billable.
  • Refunds for services already performed are not provided. Any claim for unsatisfactory work must be submitted within 24 hours of service completion to be considered.

11. Additional Work, Repairs & Subcontracting

  • Minor repairs may be performed with prior Client approval. Major repairs or specialized work will be quoted separately and, when accepted, performed under a separate work order.
  • Provider may subcontract specialized services (leak detection, major repairs, tree work) to licensed third parties; Provider remains responsible for coordination but not for third-party workmanship warranties beyond what the subcontractor provides.

12. Service Modifications & Price Changes

  • Provider may adjust service scope, frequency, or pricing to reflect property changes or material cost fluctuations. Clients will receive at least 30 days’ written notice of any general price adjustments.
  • Quoted “starting at” prices are estimates based on typical conditions; final pricing depends on property specifics.

13. Dispute Resolution & Governing Law

  • Parties agree to attempt good-faith mediation for disputes. If mediation fails, disputes shall be resolved by binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association (unless otherwise mutually agreed). Judgment on the arbitration award may be entered in any court of competent jurisdiction.
  • These Terms are governed by the laws of the State of Florida.

14. Intellectual Property & Website Use

All content on this site (text, images, logos) is the property of Pool Moon LLC. Unauthorized copying or reuse is prohibited.

15. Updates to Terms
